These Terms & Conditions govern your use of MightyWaveMarketing.com and any services provided by Mighty Wave Marketing LLC.

By using this website, purchasing a service, joining a program or membership, or otherwise working with Mighty Wave Marketing LLC, you agree to these Terms & Conditions.

Services

Mighty Wave Marketing LLC provides business consulting, marketing, advisory, training, education, group programs, memberships, and related professional services. The specific scope, deliverables, access, timeline, pricing, and other terms of a service may be described on a sales page, checkout page, invoice, proposal, order form, service agreement, or other written communication provided before or at the time of purchase.

Payments

By purchasing a service from Mighty Wave Marketing LLC, you authorize the applicable payment processor to charge the payment method you provide. Unless otherwise stated, all fees are listed and charged in U.S. dollars. You are responsible for providing accurate billing information and maintaining a valid payment method for any active service or subscription.

Recurring Billing and Automatic Renewal

Certain programs, memberships, consulting services, or other offerings may be billed on a recurring basis.

If you enroll in a recurring service, your subscription will automatically renew at the billing frequency and price disclosed at the time of purchase unless you cancel it before your next billing date. By enrolling, you authorize Mighty Wave Marketing LLC and its payment processor to automatically charge your payment method for each recurring billing period until your subscription is canceled. The amount and frequency of recurring charges will be disclosed before purchase. Pricing may change in the future. Any pricing changes that apply to an existing recurring subscription will be communicated before the new price is charged, where required.

Cancellation of Recurring Services

You may cancel a recurring subscription or membership according to the cancellation instructions provided at the time of purchase or by contacting us at MightyWaveMarketingllc@gmail.com. To avoid the next recurring charge, your cancellation request must be received before your next scheduled billing date. Cancellation stops future automatic renewals. Unless otherwise stated, canceling does not automatically result in a refund for payments that have already been processed. If you cancel during an active paid billing period, you may continue to receive access through the remainder of that paid period unless otherwise stated for the specific service.

Refunds

Refund eligibility is governed by our Refund & Cancellation Policy and any terms disclosed at the time of purchase. Unless otherwise expressly stated in writing, payments for consulting, training, memberships, group programs, digital resources, or other services are non-refundable once payment has been processed. We encourage customers to review the service description, pricing, recurring billing terms, and cancellation terms before completing a purchase. If a separate written service agreement contains different refund or cancellation terms, that agreement will control for that specific engagement.

Failed or Declined Payments

If a recurring payment is declined or cannot be processed, we may attempt to process the payment again. Access to a program, membership, service, platform, group, or digital resource may be paused or terminated if payment remains outstanding. You remain responsible for amounts properly due under the terms of your purchase.

Service Delivery

Services may be delivered through virtual meetings, group calls, digital materials, online communities, email, messaging platforms, training portals, consulting sessions, or other agreed methods. Delivery methods and schedules may vary depending on the service purchased.

For recurring memberships or group programs, access may continue for as long as the subscription remains active and payments remain current.

Client Responsibilities

You agree to provide accurate information and communicate in a timely manner when your participation is required. You are responsible for attending scheduled sessions, reviewing materials, implementing recommendations, and providing information, access, approvals, or other materials reasonably required for us to perform the services. Missed calls, failure to participate, lack of implementation, delayed responses, or failure to use available resources do not create an automatic right to a refund.

No Guarantee of Results

Mighty Wave Marketing LLC provides strategy, consulting, education, marketing guidance, training, and related services designed to help clients improve their businesses. However, business results vary based on many factors outside our control. We do not guarantee specific revenue, sales, customers, leads, profits, business growth, or other financial results. Testimonials, examples, case studies, or past client results are not guarantees that you will achieve the same or similar results. Your success depends on many factors, including your experience, effort, market, offer, execution, business conditions, and other circumstances.

Group Programs and Community Participation

Some services may include access to group calls, online communities, memberships, workshops, or other shared learning environments.

You agree to interact respectfully with other participants and not use the group to harass, threaten, spam, solicit, or misuse the personal or confidential information of others. We may remove a participant from a group, community, call, platform, or program for disruptive, abusive, unlawful, or inappropriate conduct. Removal for violation of these Terms does not automatically entitle the participant to a refund.

Confidentiality in Group Settings

Participants in group programs may voluntarily share business information, experiences, ideas, strategies, or other information.

You agree not to record, reproduce, distribute, publish, or publicly disclose another participant's confidential or private information without their permission. Because group programs include other participants, Mighty Wave Marketing LLC cannot guarantee that information voluntarily shared in a group setting will remain confidential. You should use discretion when sharing sensitive, proprietary, financial, or personal information.

Intellectual Property

Unless otherwise stated in writing, Mighty Wave Marketing LLC retains ownership of its proprietary training materials, frameworks, processes, templates, methods, presentations, recordings, educational content, and other intellectual property.

Your purchase gives you a limited right to use materials provided to you for your own personal or internal business use.

You may not reproduce, resell, distribute, publish, license, share login access, commercially exploit, or use our materials to create competing products, programs, training, or services without written permission.

Recordings

Certain group calls, workshops, trainings, or educational sessions may be recorded. If a session will be recorded, participants may be informed through the applicable program materials, platform, or session notice. Recordings may be made available to other participants in the applicable program or membership. If you do not want personal or sensitive information included in a recording, you are responsible for avoiding disclosure of that information during recorded sessions.

Client Materials

You retain ownership of materials, information, trademarks, content, and other intellectual property you provide to us.

You grant Mighty Wave Marketing LLC permission to use those materials as reasonably necessary to provide the services you purchase.

Confidentiality

We will use reasonable care when handling non-public business information shared with us during a private consulting engagement.

Information that is already public, independently developed, lawfully received from another source, or voluntarily shared in a group setting may not be treated as confidential.

Third-Party Services

Our website and services may use or link to third-party software, payment processors, scheduling systems, communication platforms, advertising platforms, website providers, training platforms, or other services. Mighty Wave Marketing LLC is not responsible for the availability, security, policies, performance, or actions of independent third-party providers. These Terms will be governed by applicable law. Any rights you may have under mandatory consumer protection laws remain unaffected.
